PARTICIPATION WAIVER

Party B acknowledges and understands that participation in soccer and athletic-related activities inherently involves substantial, unavoidable, and unforeseeable risks and dangers, including but not limited to:

• Physical contact with players, coaches, spectators, referees, equipment, structures, or surfaces

• Slips, trips, falls, collisions, tackles, impacts, headers, kicks, and bodily contact

• Sprains, fractures, strains, tears, broken bones, concussions, traumatic brain injuries, spinal injuries, paralysis, neurological injuries, cardiac events, respiratory distress, dehydration, heat illness, illness, infection, emotional trauma, psychological distress, permanent disability, and death

• Injuries caused by negligence, carelessness, acts, omissions, or conduct of participants, coaches, trainers, referees, volunteers, spectators, facility operators, or third parties

• Exposure to communicable diseases, viruses, bacteria, infections, or illnesses including but not limited to COVID-19, influenza, MRSA, and other transmissible conditions

• Risks arising from weather conditions, lightning, storms, flooding, heat, humidity, or unsafe environmental conditions

• Risks associated with athletic facilities, playing surfaces, parking areas, walkways, transportation, or defective equipment

• Risks associated with emergency medical treatment, delayed response, lack of medical personnel, or inability to access immediate care

Party B further acknowledges that no amount of supervision, instruction, training, conditioning, safety precautions, policies, medical screening, or rule enforcement can completely eliminate the risks associated with athletic participation.

Party B knowingly, voluntarily, and expressly assumes all risks, known or unknown, foreseeable or unforeseeable, associated with participation in activities connected to Party A. Such assumption of risk includes, without limitation, risks arising from:

• Athletic participation

• Physical exertion

• Travel activities

• Competition

• Training sessions

• Coaching instruction

• Facility conditions

• Participant conduct

• Negligence of Released Parties

• Any related activity associated with Nova FC

Party B accepts full responsibility for determining whether participation is appropriate based upon the participant's physical condition, health status, skill level, and medical history.

This release covers, without limitation:

• Personal injury

• Bodily injury

• Emotional distress

• Illness or disease

• Medical expenses

• Property damage

• Disability

• Permanent impairment

• Economic loss

• Wrongful death

• Any other harm or loss

arising directly or indirectly out of participation in, attendance at, observation of, travel to or from, or involvement with any Nova FC activity, program, event, camp, clinic, league, tournament, session, or operation — including claims arising from the alleged negligence, acts, omissions, carelessness, or other conduct of Party A or any Released Party.

Party B acknowledges and agrees that:

• Party A is not a medical provider

• Emergency response and medical care may be delayed or unavailable

• Participation may aggravate pre-existing conditions

Party B accepts full responsibility for all associated medical costs including:

• Medical insurance coverage

• Emergency medical costs

• Hospital expenses

• Ambulance transportation

• Therapy or rehabilitation expenses

• Prescription or treatment costs

Party B further acknowledges responsibility for disclosing any relevant medical conditions that may affect participation, including but not limited to:

• Asthma

• Cardiac conditions

• Heart defects

• Sickle Cell Trait

• Seizure disorders

• Respiratory illnesses

• Diabetes

• Allergies

• Concussion history

• Orthopedic injuries

• Any condition affecting physical activity

Failure to disclose relevant medical information releases Party A from liability associated with such undisclosed conditions.

Party A reserves the right to suspend, remove, deny participation to, or restrict access of any participant or guardian for conduct deemed unsafe, disruptive, threatening, abusive, inappropriate, unsportsmanlike, or contrary to the rules, policies, values, or standards established by Party A.

No refund or compensation shall be owed in connection with disciplinary removal or denied participation.

This Notice shall be governed by and interpreted in accordance with the laws of the State of Florida. Any dispute arising out of or related to participation in activities associated with Party A shall fall under the jurisdiction of courts located within the State of Florida. If any provision herein is deemed unenforceable, all remaining provisions shall remain in full force and effect.

Nova FC is committed to providing a safe, structured, and professionally supervised environment for all participants. Coaches and staff maintain relevant coaching education, certifications, background screenings, and safety-related training, including concussion awareness, injury prevention practices, emergency response procedures, safeguarding standards, CPR and first aid training where applicable, and general health and safety protocols.

However, despite such preparation, qualifications, supervision, policies, and preventative efforts, Party B understands and acknowledges that athletic participation and physical activity inherently involve risks that cannot be entirely eliminated, and Party A therefore disclaims liability for unforeseen incidents, injuries, illnesses, damages, or outcomes arising from participation to the fullest extent permitted by applicable law.
